Introductory provisions

These are the terms and conditions applicable to purchases from the www.merabell.com online shop. The online shop is operated by Merabell Technologies s.r.o., with registered office at Kubánské náměstí 1391/11, 100 00 Prague 10, ID: 06560024. The terms and conditions define and specify the rights and obligations of the seller (operator) and the buyer (customer).

Order and conclusion of the purchase contract

  1. All orders placed through the online shop www.merabell.com are binding. By placing an order, the Buyer confirms that he/she has read these Terms and Conditions, including the terms and conditions of the complaint and that he/she agrees to them.
  2. A proper order of goods made by the buyer is considered a proposal for the conclusion of a contract. The moment the Seller confirms the order, the purchase contract is concluded. The actual performance of the purchase contract occurs at the moment of receipt of the ordered goods.
  3. The validity of the electronic order is conditional on the completion of all the data and requirements prescribed by the form.
  4. The place of delivery of the goods is the address specified by the buyer in the registration form.
  5. The ownership of the goods passes to the buyer upon payment of the purchase price. The delivery includes a tax document.
  6. By completing the registration form or binding order within the online shop www.merabell.com, the buyer gives the seller consent to the collection and archiving of personal data about the buyer and his purchases.
  7. All prices on www.merabell.com are inclusive of VAT.
  8. All goods are the property of Merabell Technologies s.r.o. until full payment.

The Seller reserves the right to refuse to process an order if the ordering information is incomplete or raises doubts about the customer's true intention to order the goods. The Seller will send information about this refusal to the customer's e-mail address.

Payments

Payment in cash and on delivery

Everyone knows how to pay with coins and banknotes! It is the easiest and most natural way to pay for the goods we order. That's why it's a given that you can rely on this time-honoured method when you shop online at www.merabell.com or directly at Merabell Technologies s.r.o..

However, you can also pay in cash for goods you order on delivery. In this case, the package will be delivered to you by the shipping company. We do not charge anything for this service!

Prepayment - fast bank transfer via internet banking

A lightning-fast payment with just a few clicks. That's a quick bank transfer via internet banking using the Comgate payment gateway. Simply order your goods at www.merabell.com and select the "Online payment by bank transfer" option. Once your order is confirmed, you will be presented with a selection of all available payment gateways. Once you have selected a payment gateway, you will be redirected to your online banking account, which you will log into as you are used to. You will check the pre-populated payment order and confirm. The money will be sent to our account within seconds.

Delivery and service

The order created by the customer on www.merabell.com is binding for the customer and for us and will be realized by Toptrans shipping service or as agreed with the customer. The ordered goods are dispatched after agreement with the customer.

Complaints

Complaints are handled without undue delay, no later than 30 days from the date of application - return of goods, unless the seller and buyer agree on a longer period. After the expiry of this period, the buyer is granted the same rights as if it were an irremediable defect.

  1. Complaints will be handled in accordance with the terms and conditions of www.merabell.com and the legal regulations in force in the Czech Republic.
  2. The Buyer is obliged to inspect the goods upon receipt and inform the Seller of any defects immediately.
  3. The Buyer must notify the Seller of any defects in writing by completing the complaint form. He shall describe what the defects are and how they manifest themselves.
  4. In the case of delivery of an obviously damaged package, it must be inspected with the carrier upon delivery and the carrier is obliged to draw up a "Damage Report", a copy of which must be delivered to Merabell Technologies Ltd.
  5. If the Buyer sends back the defective goods, he is obliged to send the goods as he received them from the Seller, i.e. in the original packaging or packaging of adequate quality, including all components of the delivery to Merabell Technologies s.r.o., Kubánské náměstí 1391/11, 100 00 Prague 10.
  6. The Seller is not liable for poorly packed shipments and usually does not recognize the warranty for goods damaged in transit, even if the defect manifested itself before transport. Claims for defects caused by transport of goods in inadequate packaging will not be considered. The Seller shall not be liable for damages resulting from the operation of the products, functional characteristics and damages from the unprofessional use of the products, as well as damages caused by external events and faulty handling. Defects of this origin are not covered by the warranty provided. The warranty period begins on the date of receipt of the goods by the purchaser.
  7. Do not send returned goods on COD, they will not be accepted.

Withdrawal from the purchase contract (return of goods)

The buyer has the right to withdraw from the contract within 14 days of receipt of the goods in accordance with paragraph 6 of the amendment to the Civil Code No. 367/2000. If he chooses to do so, he shall send the goods back in their original packaging within this period (the date of dispatch is decisive). Upon receipt of the goods, the Seller shall promptly refund the Customer the corresponding amount in the manner agreed in advance (cash, bank transfer).
Recommendation: it is necessary that the goods come back undamaged, without signs of use or wear and tear to avoid subsequent recovery by the seller.

Please do not send returned goods to us on COD. Goods returned in this way will not be accepted and will prolong the processing time. In addition, in individual cases, demonstrable administrative charges may be charged and subsequently enforced according to the law by all available means.

Referral

  1. The buyer is not entitled to assign any rights and claims under the contract to a third party without the prior written consent of Merabell Technologies Ltd.
  2. The Buyer is not entitled to unilaterally set off any rights against a claim of Merabell Technologies s.r.o.

Final provisions

  1. These terms and conditions are valid as they appear on the Seller's website on the date of the Buyer's submission of the electronic order.
  2. By submitting an electronic order, the Buyer accepts without reservation all provisions of the Terms and Conditions in the version valid on the date of the order submission, as well as on the date of the order submission, the valid price of the ordered goods, including shipping or postage costs, as listed in the catalogue of the Internet shop www.merabell.com, unless otherwise demonstrably agreed in a particular case. The Buyer is irrevocably bound by the order sent.
  3. The Customer may cancel the order without the consent of the Seller within a maximum of 24 hours of ordering, or if the delivery period confirmed in writing by the Supplier is exceeded. In other cases, agreement with the seller is required.
  4. The parties have expressly agreed, in accordance with Section 262 (1) of the Commercial Code, that unless the terms and conditions expressly provide otherwise, their rights and obligations shall be governed by the Commercial Code, in particular Sections 409 et seq.

Protection of personal data

The company Merabell Technologies s.r.o., with its registered office at Kubánské náměstí 1391/11, 100 00 Prague 10, ID No.: 06560024 (hereinafter referred to as "Merabell Technologies"), as a personal data controller, hereby informs about the manner and scope of processing of personal data by this company, including the scope of the data subject's rights related to the processing of their personal data by Merabell Technologies.

Merabell Technologies processes personal data in accordance with the law of the European Union, in particular in accordance with Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as well as in accordance with international treaties to which the Czech Republic is bound, in particular in accordance with the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data No. 108, promulgated under No. 115/2001 Coll, 101/2000 Coll., on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter referred to as the "PDPA").

Purpose and scope of personal data processing:

Merabell Technologies only processes the precise personal data it has obtained in accordance with the ZOOU, and Merabell Technologies collects and processes this personal data only for the stated purpose, within the scope set out below, for a period of 7 years, but no longer than until your consent to the processing of your personal data (for this processing purpose) is withdrawn.

The main purposes of the processing of personal data by Merabell Technologies:

  • Performance of the purchase contract and provision of services;
  • accounting and tax purposes;
  • debt collection;
  • compliance with legal obligations;
  • direct marketing (information and product campaigns) of Merabell Technologies;
  • customer record keeping.

Scope of processing of personal data by Merabell Technologies:

Merabell Technologies processes personal data to the following extent:

  • Your name;
  • your company name;
  • address or registered office of the company;
  • identification number and tax identification number;
  • delivery address;
  • telephone number;
  • e-mail address;

Sources of personal information:

Merabell Technologies obtains personal data mainly from the data subject in the context of contract negotiations. The provision of personal data will facilitate the communication between the data subject and Merabell Technologies and will also significantly improve the efficiency of the provision of services.

Merabell Technologies automatically collects certain information about the users of its website in the course of standard Merabell Technologies server operations (e.g. the IP address of the user's computer) and also when using cookies (small text files that are stored on the user's computer and which enable the server to recognise a user who has already visited the website once and then record their behaviour and, for example, adapt the design and content or better target advertising campaigns accordingly). Cookies are not programs that can cause damage to the user's computer. Most browsers offer the option not to accept cookies - however, e-commerce will not function properly without cookies enabled (see more in the section "Cookies" below).

Processors and recipients:

In addition to Merabell Technologies and its employees, personal data may also be processed by processors working for Merabell Technologies for the purposes described above, on the basis of data processing agreements concluded in accordance with the Personal Data Protection Act.

Merabell Technologies processes personal data manually and automatically. The protection of personal data is technically and organisationally ensured by Merabell Technologies in accordance with the PDPA. Merabell Technologies requires the same security from the processors of personal data.

Merabell Technologies informs that personal data may be transferred to third parties who have the legal authority to require the transfer of the personal data in question, upon a lawful request. Merabell Technologies does not pass on personal data about its customers to other entities, unless they are contractual carriers who provide transport of goods to customers (to whom the information on name, surname and delivery address is passed on) - e.g. Czech Post, DHL, PPL, etc.

Rights of data subjects:

The data subject is entitled to request information about the processing of his/her personal data, the purpose of the processing of personal data, the scope or categories of personal data subject to processing, the sources of personal data, the nature of automated processing, the processors, the recipients or categories of recipients of personal data.

Merabell Technologies will provide the communication of the requested information without undue delay, for a reasonable fee not exceeding the costs necessary to provide such information.

In the event that the data subject becomes aware or believes that Merabell Technologies or a Merabell Technologies contract processor is carrying out processing of personal data which is contrary to the protection of the data subject's private and personal life or contrary to law, the data subject shall be entitled to:

  • request an explanation from Merabell Technologies or its contractual processor;
  • request that Merabell Technologies or its contractual processor remedy the situation; in particular, the data subject is entitled to request the blocking, rectification, completion or destruction of the personal data.

Merabell Technologies shall always inform the data subject without undue delay of the processing of his or her request. The data subject shall have the right to refer the matter to the Data Protection Authority at any time.

In order to improve the service provided to you, our website uses cookies. Cookies are small files that store information in your browser and are commonly used to distinguish individual users. However, the user's person is not identifiable on the basis of this information. Cookies thus help, for example:

  • the correct functionality of our site, so that the purchase process can be completed with the least possible difficulty
  • remembering our customers' login details so that they do not have to enter them each time
  • to find out which pages and features visitors use most often - so we can best tailor our offer to your requirements
  • help us find out which ads visitors view most often so that they don't see the same ads over and over again as they browse the site, or so that they don't see ads for products they're not interested in

GDPR regulation

Merabell Technologies hereby wishes to inform you that on 25 May 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as "GDPR") entered into force and is directly effective within the legal system of the Czech Republic. As a consequence of this fact, as of 25 May 2018, it fully reflects the new legal regulation on the protection of personal data of natural persons regulated by the GDPR.

Definition of terms used:

  • personal data - personal data is any information relating to an identified or identifiable data subject; a data subject is considered to be identified or identifiable if the data subject can be directly or indirectly identified;
  • data subject - the data subject is the natural person to whom the personal data relate;
  • controller - a controller is any entity which determines the purpose and means of processing personal data, carries out the processing and is responsible for it;
  • processor - a processor is any entity which, on the basis of a specific law or a mandate from the controller, processes personal data pursuant to this Act;
  • recipient - a recipient is any entity to which personal data are disclosed;
  • customer - a customer is a legal or natural person with whom Merabell Technologies has a contractual relationship;
  • processing of personal data - processing of personal data means any operation or set of operations which the controller or processor systematically performs on personal data, whether by automated means or by other means; processing of personal data means, in particular, collection, storage on a medium, disclosure, adaptation or alteration, retrieval, use, transmission, dissemination, disclosure, storage, exchange, classification or combination, blocking and destruction
